WHAT ARE REQUIREMENTS/PROCEDURE TO LEGALLY PROTECT DESIGN?

Design is protected by exclusive right (design right) if it is new and if it has good individual character.

Novelty – design is deemed new if an identical design has not become accessible to public before the day of submitting the application to acknowledge that design, or if there is no application previously submitted to acknowledge the identical design.

Individual character – a design has individual character if a total impression it has on an informed user is different from a total impression that any design has on the same user, and which became accessible to public prior to the day of submitting the application for recognition, or on the day preferential right of opposed design has been recognised.
